2. What data we collect
When you use FairGain, we may collect the following personal data:
- Name and email address (account registration)
- Instagram account information: username, account ID, follower/following counts, profile picture (when you connect via OAuth)
- Audience demographics: aggregated city, country, age, and gender breakdowns of your Instagram followers
- Payment information: IBAN, Papara number (for payouts); card details are processed by Stripe and never stored on our servers
- Campaign and story mention data: story URLs, detection timestamps, duration, engagement metrics
- Device and usage data: IP address, browser type, pages visited
3. Why we process your data
We process your personal data for the following purposes and legal bases:
- Contract performance: operating the platform, managing campaigns, verifying story mentions, processing payments and payouts
- Legitimate interest: fraud prevention, trust scoring, platform security, improving our services
- Legal obligation: tax reporting, anti-money-laundering compliance, responding to law enforcement requests
- Consent: marketing emails (you can opt out at any time)
4. Who we share data with
We share personal data only with the following categories of recipients, and only to the extent necessary:
- Stripe (Stripe Payments UK Ltd) for processing campaign payments and booster payouts
- Instagram / Meta for OAuth authentication, story detection, and engagement verification
- Wise (Wise Payments Ltd) for business banking and payout settlement
- Resend for transactional email delivery (approval notifications, payout confirmations)
- Cloudflare / Vercel for hosting, CDN, and media storage
- Sentry for error monitoring (anonymised technical data only)
We do not sell your personal data to third parties.
5. International transfers
Your data may be transferred to and processed in countries outside the UK, including Turkey and the United States (where some of our service providers operate). Where this happens, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses approved by the UK ICO, or the recipient being in a country with an adequacy decision.
6. How long we keep your data
- Account data: retained while your account is active, then deleted within 30 days of account closure (subject to legal retention requirements)
- Financial records (payments, payouts): 7 years (UK tax and accounting obligations)
- Campaign and story mention data: retained for the life of the campaign plus 12 months
- Instagram access tokens: refreshed automatically and deleted upon account disconnection
7. Your rights
Under UK GDPR, you have the following rights:
- Access: request a copy of the personal data we hold about you
- Rectification: request correction of inaccurate or incomplete data
- Erasure: request deletion of your personal data (subject to legal retention obligations)
- Restriction: request that we limit how we process your data
- Portability: request your data in a structured, machine-readable format
- Objection: object to processing based on legitimate interest
- Withdraw consent: where processing is based on consent, withdraw it at any time

8. Cookies
We use essential cookies for session management and authentication. These are strictly necessary for the platform to function. We do not use tracking or advertising cookies unless you consent via our cookie banner.
9. Data security
We protect your data using TLS/SSL encryption in transit, encrypted database storage at rest, and access controls limiting who can view personal data. Payment card details are handled entirely by Stripe and never touch our servers.
